SCOTUS takes up Trump's case on birthright citizenship

The Supreme Court said Friday it would hear an expedited appeal of President Donald Trump’s case seeking to end birthright citizenship by executive order.

The Supreme Court did not explain the decision. An oral debate will likely be scheduled next spring and will be decided by the end of June.

This is the second time Trump’s order has come before the court, but this time the justices are expected to review it on the merits.

For more than 100 years, courts and the government have interpreted the Constitution as granting U.S. citizenship to anyone born on U.S. soil, regardless of the legal status of the child’s parents.

Upon taking office for a second term, Trump signed an executive order seeking to discontinue that practice and limit citizenship only to children born to parents who are legal permanent residents or citizens.

Federal appeals courts have blocked Trump’s order nationwide, finding it illegal on its face.
