Prosecutors trying to 'bias' to the public against Luigi Mangione, says the defense

The prosecutors of the Office of the District Prosecutor of Manhattan intentionally violated the right of Luigi Mangione in a right trial by unnecessarily released their daily written inputs to the “bias” of the public, defense lawyers said in a new judicial presentation.

Prosecutors included writings in a presentation earlier this month that was destined to justify the presentation of murder positions with an improvement of terrorism. An excerpt said: “I finally feel sure what I will do. The details are joining. And I feel no doubt about whether it is correct/justified. I’m glad in a way that has postponed because it allowed me to learn more about UHC.”

Mangione, who recently turned 27 in jail, is accused of killing the executive president of United Healthcare, Brian Thompson, after harassing him outside a Midtown hotel.

“The defense has provided irrefutable evidence that the search for Mr. Mangione’s alleged backpack can be illegal and, therefore, its fruits can be suppressed. In response, the Prosecutor’s Office prevently released its alleged magazine to the public. The actions of the Prosecutor’s Office do not admit any legitimate objective,” said the defense presentation. “The only reason that makes sense is that the Prosecutor’s Office expects to biased the public against Mr. Mangione and undermine his right to a fair trial.”

Mangione defense lawyers are trying to delay or dismiss the state’s case to concentrate on federal prosecution, which could obtain the death penalty. He declared himself guilty of state and federal positions.

“Forcing the accused to choose between affirming a potential defense in the State Court and giving the Prosecutor’s Office in their capital trial, an unfair advantage presents to the defense an unsustainable option with possibly fatal implications,” defense lawyers said.

Mangione will be next September after a previously scheduled audience was rescheduled for June 26. He must appear in a federal court in December, at which time the judge said that she would establish a trial date. It is not yet clear what prosecution will proceed first.

He declared himself innocent of all the charges. Prosecutors opposed a defense motion to suspend the state case in favor of the federal case, which Seidemann said it could take years to try due to the intention of the government to seek the death penalty.

He is detained in federal custody at the Metropolitan Detention Center in Brooklyn.
